1. Acceptance of Terms
By creating an account or using any Autokentic product, you confirm that you are at least 18 years old, have the authority to enter into these Terms, and agree to comply with them in full. If you are using the service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Services
Autokentic provides AI-powered software-as-a-service (SaaS) tools designed to help small businesses and independent founders automate repetitive business tasks. Our services include, but are not limited to, AI-assisted email drafting, automated reporting, and follow-up automation tools. We reserve the right to modify, suspend, or discontinue any service or feature at any time with reasonable notice.
3. Account Registration
To access our services, you must create an account. You agree to provide accurate, current, and complete information during registration; maintain the security of your password and account; promptly update your account information if it changes; and accept responsibility for all activity that occurs under your account. You must notify us immediately at hello@autokentic.com if you suspect unauthorized access.
4. Subscriptions and Billing
Autokentic offers monthly subscription plans. By subscribing, you authorize us to charge the applicable fees to your payment method on a recurring basis. All fees are stated in US dollars and are exclusive of applicable taxes.
You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months or unused portions of a subscription, except where required by law. We reserve the right to change pricing with at least 30 days notice. Continued use of the service after a price change constitutes acceptance of the new pricing.
5. Free Trials
We may offer free trials for new customers. You may be required to provide payment information to begin a trial. Unless you cancel before the trial ends, your subscription will automatically begin and you will be charged the applicable plan fee.
6. Acceptable Use
You agree to use Autokentic services only for lawful purposes and in accordance with these Terms. You may not use our services to:
- Violate any applicable local, national, or international law or regulation
- Send spam, unsolicited messages, or bulk communications without consent
- Transmit any content that is defamatory, obscene, fraudulent, or harmful
- Reverse engineer, decompile, or attempt to extract source code from our software
- Interfere with or disrupt the integrity or performance of the services
- Use the services to train competing AI or machine learning models
- Misrepresent your identity or affiliation with any person or organization
7. Intellectual Property
All content, features, and functionality of Autokentic's services are the exclusive property of Autokentic and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the services for your internal business purposes during the term of your subscription.
Any content you submit or upload through our services remains your property. By submitting content, you grant Autokentic a limited license to process and use that content solely to provide the services to you.
8. Privacy
Your use of Autokentic's services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the services will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, Autokentic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the services. Our total liability to you for any claim shall not exceed the total fees paid by you in the three months preceding the event giving rise to the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless Autokentic and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the services, your content, or your violation of these Terms.
12. Termination
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms. You may terminate your account at any time by canceling your subscription and ceasing use of the services.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or a prominent notice in the service at least 14 days before the changes take effect. Your continued use of the services after changes become effective constitutes acceptance of the revised Terms.
